General terms and conditions

GENERAL TERMS AND CONDITIONS (GTC)
Skiverleih Die2 KG
Version dated: 28 October 2026
1. Scope
These General Terms and Conditions apply to the rental of skis, snowboards, ski boots, ski poles, helmets and other sports equipment by Skiverleih Die2 KG.
They apply to online bookings as well as rental agreements concluded directly on site.
Customers' mandatory statutory rights remain unaffected.
2. Online Booking and Conclusion of the Contract
The desired equipment, rental period and any additional services are selected in the online booking system.
Before the booking is completed, the selected equipment, rental period, total price including any discount granted, and any additional costs are displayed.
The rental contract is automatically concluded once the booking process has been successfully completed and payment has been received successfully. The customer receives an electronic booking confirmation.
The online booking is binding once the booking process has been successfully completed and the booking has been confirmed.
These General Terms and Conditions are made available to the customer before the booking is completed and must be validly incorporated into the contract.
3. Prices, Online Payment and Discount
For online bookings, the full rental price must be paid in advance.
Customers who pay the full amount online in advance receive a 10% discount on the regular rental price of the booked equipment. The discount is shown during the booking process and included in the total amount payable.
The discount applies exclusively to online bookings where the full amount is paid in advance.
For bookings made on site and paid for in cash, the regular rental price communicated before the booking applies. No entitlement to the online discount applies to this payment method.
The total price displayed before the booking is completed is the applicable price. All legally required price information and any additional costs are clearly displayed before the booking becomes binding.
4. Bookings and Payments on Site
The desired equipment can also be rented directly on site, subject to availability.
For bookings made on site, the agreed rental price must be paid no later than when the equipment is collected. Cash payment is accepted.
The 10% online discount does not apply to bookings made and paid for on site.
5. Cancellations and Changes to Bookings
5.1 Free Cancellation Up to 72 Hours Before the Rental Period Begins

A confirmed online booking can be cancelled free of charge up to 72 hours before the agreed rental period begins.
Cancellations must be sent by email to one of the following addresses:
info@skiverleihdie2.at
die2@skiverleihdie2.at
The time at which the cancellation email is received at either of these addresses is decisive.
If the cancellation is made within the permitted period, the rental price already paid will be refunded in full. The refund will generally be made using the original payment method.
5.2 Cancellation Less Than 72 Hours Before the Rental Period Begins
After the free cancellation period has expired, there is no entitlement to free cancellation under this voluntary cancellation policy.
Whether and to what extent a refund is due depends on the agreed contractual terms and the applicable legal provisions.
This provision alone does not automatically create an obligation to pay an additional cancellation fee.
Mandatory statutory rights of withdrawal and refund remain unaffected.
5.3 Failure to Arrive and Early Return
If the customer does not arrive at the agreed collection time or returns the equipment before the end of the rental period, the rights and obligations of the parties are governed by the validly agreed contractual terms and the applicable legal provisions.
A refund for unused rental days is due only where this has been agreed or is required by mandatory statutory provisions.
5.4 Changes to Bookings
Changes to bookings are possible subject to availability. Changes to the rental period or equipment require confirmation by Skiverleih Die2 KG.
If an approved change results in a price difference, the difference must be agreed with the customer before the change is made.
6. Illness or Accident During the Rental Period
If a customer is unable to continue using the rented equipment due to illness or an accident during the rental period, we will be happy to find a straightforward solution.
Upon presentation of a medical certificate and return of the rented equipment, the rental charge will be adjusted from the date of the medical certificate. Any rental fees already paid for the remaining rental period will be refunded on a pro-rata basis.
This arrangement applies to the person directly affected. The rental conditions for other people included in the same booking remain unchanged.
Mandatory statutory rights remain unaffected.
7. Minimum Rental Period and Return of Equipment
The minimum rental period for winter sports equipment is one day.
The agreed rental period is specified in the booking confirmation or in the agreement made on site.
If the equipment is returned on the agreed return date by 10:30 a.m. at the latest, that day will not be charged as an additional rental day.
If the equipment is returned after 10:30 a.m., an additional rental day may be charged in accordance with the price list communicated before the booking.
If the equipment is returned after 4:00 p.m., rental charges may continue from the following day at the agreed rental rates, provided this is set out in the pricing policy clearly communicated to the customer.
The equipment must be returned complete and in proper condition, allowing for normal wear and tear.
If the equipment cannot be returned on time, the customer must inform Skiverleih Die2 KG without delay.
8. Deposit and Security
As a rule, no deposit is required when renting equipment.
The absence of a deposit does not release the customer from the obligation to be responsible for damage or loss caused through their fault, in accordance with the applicable legal provisions.
9. Duty of Care and Transfer of Rental Equipment
The customer agrees to use the rented equipment carefully and for its intended purpose, and to follow the instructions provided for its use.
The customer may not transfer or sublet the rented equipment to third parties without the prior consent of Skiverleih Die2 KG.
Any visible damage, malfunction or safety defect must be reported immediately. If the equipment poses a safety risk, it must not be used further.
The equipment must be returned at the agreed time and to the agreed return location.
10. Loss, Theft, Breakage and Damage
Unless the customer has been expressly informed otherwise, the rental equipment provided by Skiverleih Die2 KG is not insured against breakage or theft.
The customer is liable for loss, theft or damage to the extent permitted by law and where the legal requirements for liability are met.
In cases of intentional damage or other damage caused through the customer's fault, the actual repair costs incurred and legally recoverable may be charged. If repair is impossible or not economically reasonable, reasonable compensation for the proven loss may be claimed, taking the current value of the equipment into account.
Skiverleih Die2 KG must be informed immediately in the event of loss or theft. In the event of theft, a police report must be filed and proof of the report must be provided.
Under the policy applied by the business, theft from fixed premises, particularly a ski storage room, is not covered by insurance. Even in such cases, the customer's liability is governed by the applicable legal provisions and the contractual terms validly agreed.
Compensation based on the current value may be claimed, to the extent permitted by law, for lost or stolen rental items and for items that can no longer be used due to damage caused through the customer's fault.
The customer is liable only where the legal requirements for liability are met. The mere fact that theft has occurred does not automatically create liability regardless of fault.
The customer is not liable for normal wear and tear resulting from proper use in accordance with the contract.
11. Ski Binding Adjustment and Safety Inspection
Skiverleih Die2 KG recommends having ski bindings professionally adjusted and the relevant safety checks carried out.
A fee of €15.00 is charged for the offered binding adjustment and safety inspection, provided the service is used and has not already been included in the displayed rental price.
Please allow at least 20 minutes for this service.
The customer must provide complete and accurate information required for a proper adjustment. Any changes to relevant information must be communicated before the adjustment is carried out.
No blanket exclusion of liability for accidents, damage or injuries is agreed. Skiverleih Die2 KG is liable in accordance with the applicable legal provisions.
If damage results from incorrect or incomplete information provided by the customer, any liability is determined in accordance with the applicable legal provisions and the circumstances of the individual case.
12. Exchange of Sports Equipment
Exchanging equipment for a different ski model, different ski boots or other sports equipment in the same price category is generally free of charge during the rental period, subject to availability.
There is no entitlement to a specific model or brand unless this has been expressly agreed.
Exchanging equipment for items in a higher price category may result in an additional charge. Any such charge must be agreed with the customer before the exchange takes place.
13. Force Majeure and Weather Conditions
Unfavourable weather, lack of snow, restricted ski operations or the customer's personal decision not to use the equipment do not automatically entitle the customer to free cancellation or a refund.
The customer's statutory rights and any claims arising from non-performance or improper performance of the contract remain unaffected.
14. Data Protection and Personal Information
Skiverleih Die2 KG processes customers' personal data for specific purposes and in accordance with the applicable data protection laws.
Personal data provided during booking or ordering is processed for the purpose of preparing, performing and administering the contract and fulfilling legal obligations.
Where necessary for booking administration, payment processing, communication or compliance with legal obligations, personal data may be transferred to the payment service providers, booking system providers, IT service providers or other recipients involved as required.
Data will be processed for other purposes only where an appropriate legal basis exists.
Further information about the processing of personal data, the legal bases for processing, recipients, retention periods and the rights of data subjects is provided in the separate Privacy Policy on the website.
15. Applicable Law and Jurisdiction
Austrian law applies to the extent that this choice of law is legally permitted.
Mandatory statutory consumer protection provisions and rules on jurisdiction remain unaffected.
The competent courts are determined in accordance with the applicable legal provisions. Any agreement on a different place of jurisdiction is valid only to the extent permitted by law.
16. Final Provisions
If any provision of these General Terms and Conditions is or becomes wholly or partly invalid, the applicable statutory provisions shall apply.
The invalidity of an individual provision does not automatically affect the validity of the remaining provisions.
